Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Pratfoundy mobile application, the website at https://pratfoundy.app, and related services (together, the "Service").

By creating an account, selecting the acceptance checkbox, purchasing a product, or using the Service, you agree to these Terms and acknowledge the Privacy Policy. If you do not agree, do not use the Service.

1. Service provider

The Service is operated under the Pratfoundy brand by an individual operator based in Latvia ("Pratfoundy", "we", "us", or "our"). Pratfoundy is a brand and not a separate incorporated legal entity.

2. Eligibility

You must be at least 13 years old and legally capable of agreeing to these Terms. If the law where you live requires parental or guardian consent at a higher age, you may use the Service only with that consent. The Service is not directed to children under 13.

3. Accounts

An account is required for the main features of the Service. Supported sign-in methods may include email and password, Google Sign-In, and Sign in with Apple. Available methods can differ by device or platform.

You agree to provide accurate information, keep your credentials secure, and promptly notify us of suspected unauthorized use. You are responsible for activity performed through your account except to the extent caused by our failure to use reasonable security measures.

You may not create accounts through automated or deceptive means, impersonate another person, sell or transfer an account, share credentials in a way that compromises security, or create multiple accounts to evade restrictions.

4. The Service

Pratfoundy provides educational lessons, questions, progress tracking, learning goals, badges, streaks, playbooks, and related features concerning entrepreneurship, management, finance, sales, marketing, and other business topics.

We may improve, add, modify, suspend, or discontinue features. We will take reasonable steps to avoid materially reducing paid functionality during an active paid period, except where a change is required for security, legal compliance, platform requirements, or circumstances outside our reasonable control.

4.1 Learning notifications

Pratfoundy may offer optional reminders about daily learning, streaks, progress, or unfinished lessons. When you first enter the Welcome screen and notification permission is undecided, your device may show its system permission dialog; Home may perform the same check as a fallback. If permission is not granted, Pratfoundy may later show an in-app reminder on Welcome or Home requiring Allow notifications or Not now before it is dismissed. Denying permission or choosing Not now does not prevent use of the Service. You can later turn notifications on or off in Pratfoundy Settings and in your device settings.

Notification timing and delivery are not guaranteed. They can be delayed, suppressed, or prevented by your preferences, quiet hours, learning state, device settings, connectivity, Apple, Google, Expo, or other providers. Notification text is a reminder only and does not change lesson availability, progress, purchase rights, deadlines, or these Terms.

5. Educational information — not professional advice

The Service is for general educational and informational purposes. It does not provide financial, investment, legal, tax, accounting, employment, or professional business advice, and it does not create a fiduciary, advisory, attorney-client, or professional relationship.

Business and financial decisions involve risk. Information may be simplified, incomplete, or become outdated. You should verify important information and consult a qualified professional before acting. We do not guarantee income, business success, investment performance, examination results, or any other outcome.

6. Purchases and subscriptions

6.1 Available products

The Service may offer monthly or annual auto-renewing subscriptions, a non-consumable lifetime-access purchase, optional support purchases, free trials, introductory offers, or other products. Only products and terms displayed in the app and confirmed by the applicable app store are offered to you.

6.2 Billing

Purchases are processed by Apple App Store or Google Play, not directly by us. Prices, currency, taxes, trial eligibility, billing date, and payment methods are displayed by the applicable store before confirmation. We do not receive your full payment-card information.

Auto-renewing subscriptions continue for successive billing periods unless canceled through the applicable store before renewal. Your Apple or Google account is charged according to the store terms shown at purchase. If a free trial or introductory period is offered, the subscription converts to the displayed paid price unless canceled before the trial or offer ends.

You can manage or cancel subscriptions through your Apple App Store or Google Play account. Canceling normally prevents the next renewal; access may continue until the end of the already-paid period.

6.3 Lifetime access and support purchases

"Lifetime" means access to the applicable Pratfoundy premium features for as long as we continue to operate and support the Service. It does not guarantee that every present feature will remain unchanged forever or that the Service will operate indefinitely.

Optional support purchases do not represent charitable donations, investments, equity, loans, or entitlement to financial return unless the purchase screen expressly states otherwise.

6.4 Restore, refunds, and statutory rights

Use the in-app restore function to restore eligible purchases associated with the same Apple or Google account. Purchase records and entitlement status may be processed by RevenueCat to provide this functionality.

Refund requests are handled under Apple App Store or Google Play procedures. Nothing in these Terms limits refund, withdrawal, conformity, or other mandatory consumer rights that cannot lawfully be excluded in your country.

6.5 Account deletion and subscriptions

Deleting your Pratfoundy account or uninstalling the app does not automatically cancel an Apple or Google subscription. Cancel the subscription in your store account to prevent future renewal. If you delete the Pratfoundy account first, you may lose access to entitlement restoration within the Service while store billing continues.

7. Advertising

The free version may display third-party advertising. Advertising availability and personalization depend on your region, consent choices, device settings, and platform permissions. Premium access is intended to remove in-app advertising while the entitlement remains active.

8. License to use the Service

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Service for lawful, non-commercial purposes on devices you own or control, subject to applicable Apple or Google usage rules.

No ownership rights are transferred to you.

9. Intellectual property

The Service, including its software, visual design, brand, logos, text, lessons, questions, explanations, structure, graphics, audio, and other content, is owned by or licensed to Pratfoundy and is protected by intellectual-property laws.

Except where law permits otherwise, you may not:

• copy, reproduce, republish, sell, license, or commercially exploit Service content;
• scrape, systematically download, or create a competing dataset from lessons or questions;
• reverse engineer, decompile, or bypass technical protection measures;
• remove copyright, trademark, or proprietary notices;
• use Pratfoundy branding in a way that suggests endorsement or affiliation.

Mandatory legal exceptions, including certain interoperability rights, remain unaffected.

10. Feedback and content you submit

If you send feedback, ideas, text, screenshots, or other materials, you retain ownership of your original content. You grant us a worldwide, non-exclusive, royalty-free license to host, reproduce, and use that material only as reasonably necessary to provide support, investigate issues, secure and improve the Service, and comply with law.

You must have the right to submit the material and must not send unlawful content, confidential information belonging to another person, malicious code, or content that infringes third-party rights.

11. Acceptable use

You must not:

• violate applicable law or another person's rights;
• interfere with, overload, damage, or disrupt the Service;
• access another user's account or data without authorization;
• probe, scan, exploit, or attempt to defeat security controls;
• manipulate purchases, premium status, XP, fuel, progress, badges, or results through unauthorized means;
• use bots, scripts, emulators, or automated systems to abuse the Service;
• submit malware, deceptive requests, spam, or fraudulent information;
• use the Service to develop, train, benchmark, or populate a competing product by systematically extracting protected content.

Good-faith security reports sent privately to info@pratfoundy.app are not prohibited.

12. Third-party services

The Service relies on third parties including Apple, Google, Supabase, RevenueCat, Firebase, AdMob, Expo and Expo Push Service, Resend, and Cloudflare. Their services may be governed by separate terms and privacy notices. We are not responsible for third-party services outside our reasonable control, but this does not limit responsibility imposed on us by mandatory law.

Apple and Google are not responsible for providing Pratfoundy support. To the extent required by the applicable platform terms, Apple or Google and their subsidiaries may be third-party beneficiaries of provisions relating to your platform use.

13. Account deletion

You may submit a request to permanently delete your account in the app through:

Settings → Account → Delete Account

We review submitted requests and normally complete deletion within 14 days. The account may remain accessible during the review period. If you cannot access the app, visit https://pratfoundy.app/delete-account/ or contact info@pratfoundy.app. We may verify your identity before acting on an external request.

Deletion is intended to remove your account and associated data under our control, subject to limited legal, security, fraud-prevention, transaction-record, and backup retention described in the Privacy Policy. Account deletion is permanent and learning progress may not be recoverable.

Remember to cancel any active Apple or Google subscription separately before or after deleting the account.

14. Suspension and termination

We may restrict or suspend access where reasonably necessary to investigate security incidents, prevent harm, comply with law, address non-payment or reversed transactions, or respond to a material or repeated breach of these Terms.

We may terminate an account for serious or repeated violations, fraud, attacks on the Service, or legal requirements. Where appropriate and lawful, we will provide notice or an opportunity to remedy the issue. Immediate action may be taken where necessary to protect users, the Service, or third parties.

Termination does not cancel obligations already incurred and does not automatically cancel subscriptions billed by Apple or Google.

15. Availability and updates

We aim to provide a reliable Service but cannot guarantee uninterrupted or error-free operation. Maintenance, provider outages, device compatibility, network conditions, security events, and legal or platform requirements may affect availability.

You are responsible for installing reasonably required app and operating-system updates. Older versions may stop working where necessary for security, compatibility, or backend changes.

16. Disclaimers

To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available." We disclaim implied warranties that may lawfully be excluded, including merchantability, fitness for a particular purpose, and non-infringement.

These disclaimers do not exclude statutory guarantees, consumer rights, or liability that cannot lawfully be excluded.

17. Limitation of liability

Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, gross negligence, death or personal injury caused by negligence, breach of mandatory consumer rights, or any liability that cannot legally be excluded or limited.

Subject to the preceding sentence and to the maximum extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, business opportunity, goodwill, or data that was not reasonably foreseeable when you accepted these Terms.

Where liability may lawfully be limited, our aggregate liability relating to the Service will not exceed the greater of the amount you paid for the Service during the 12 months before the event giving rise to the claim or EUR 50.

18. Your responsibility for losses

If you use the Service commercially, unlawfully, or in material violation of these Terms, you are responsible for reasonably foreseeable losses and third-party claims caused by that conduct. This section does not apply to the extent prohibited by consumer law and does not require a consumer to compensate us for losses not caused by that consumer.

19. Governing law and disputes

These Terms are governed by the laws of Latvia, without depriving consumers of mandatory protections provided by the law of their country of residence.

Before filing a claim, please contact info@pratfoundy.app so we can try to resolve the issue. If you are a consumer, you may bring proceedings in the courts available under mandatory consumer-jurisdiction rules, including the courts of your habitual residence where applicable. We may bring proceedings against a consumer only where permitted by those rules.

20. Changes to these Terms

We may update these Terms for legal, security, technical, or Service changes. We will publish the updated Terms and update the date above. Where a change is material, we will provide additional notice and request renewed acceptance where required. Changes do not retroactively reduce rights already accrued under a paid purchase.

21. General terms

If a provision is unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions continue in effect. A delay in enforcing a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a lawful reorganization or transfer of the Service, subject to applicable consumer and privacy law.
